Terms and Conditions

These Terms and Conditions ("Agreement") govern the purchase and use of all Mavinpro Fitness products, parts, and/or services (“Products”) by the Buyer. By placing an order, the Buyer agrees to be bound by these terms.

1. ORDER ACCEPTANCE & MODIFICATIONS

(A) Order Confirmation

Orders are subject to acceptance by Mavinpro Fitness. An order is confirmed once we issue written confirmation or begin processing the Order.

(B) Modifications & Cancellations

Order modifications require written approval and may be subject to additional costs or delays.

Orders may be canceled within 7 days of payment, but the Buyer is responsible for bank processing fees.

Cancellations made after 7 days but within 60 days of delivery will be subject to a 20% restocking fee due to production commencement.

2. PRICING & PAYMENT TERMS

(A) Pricing

Prices are in U.S. dollars and subject to change without notice unless otherwise specified in a written agreement.

Prices do not include shipping, taxes, customs duties, or other applicable fees, unless expressly stated.

(B) Payment Options & Terms

Wire Transfer:

50% advance payment before production.

Remaining 50% balance due before shipping.

Credit Card Payment:

60% advance payment before production.

Remaining 40% balance due before shipping.

Stock Orders or Single-Unit Purchases:

Full 100% upfront payment required.

Payment is due within 30 days of invoice date, unless agreed otherwise in writing.

Late payments incur a 3% monthly interest fee or the maximum allowed by law.

3. DELIVERY & SHIPPING

(A) Delivery Timeline

Mavinpro Fitness will use reasonable efforts to deliver Products on the requested delivery date. However, all delivery dates are estimates and not guaranteed.

(B) Delays Caused by Buyer

If the Buyer requests or causes a delay in delivery, the following apply:

50% of the total invoice price due for orders delayed more than 30 days beyond the original delivery date.

A delay fee of 0.5% per month of the total invoice price from the original delivery date until delivery.

(C) Partial Shipments

Mavinpro Fitness may ship orders partially and will invoice for each partial shipment.

(D) Risk of Loss & Title Transfer

Risk of loss transfers to the Buyer once the Products are shipped.

The Buyer is responsible for purchasing liability insurance if required.

4. RETURNS & REFUNDS

(A) Return Policy

Buyers may request a return or refund within 3 business days of receiving the order.

The Buyer is responsible for all return-related costs, including:

Bank processing fees

Transportation and shipping fees

Loading and offloading fees

Labor costs

Returns requested after 3 business days will be subject to a 20% restocking fee.

Any damage incurred during return transportation is the Buyer’s responsibility.

(B) Non-Returnable Items

Custom orders, special production items, and clearance sale items are final sale and cannot be returned.

5. LIMITED WARRANTY

(A) Warranty Coverage

Mavinpro Fitness offers a 90-day limited warranty on Easy-Tier parts.

This warranty does not cover:

Normal wear and tear

Improper use, installation, or maintenance

Unauthorized modifications or repairs

(B) Warranty Claims

Claims must be submitted in writing with proof of purchase.

Mavinpro Fitness reserves the right to inspect returned Products before approving warranty claims.

6. LIABILITY LIMITATIONS

(A) Buyer’s Responsibility

The Buyer must inspect all Products upon delivery and report defects within 3 business days.

(B) Exclusions

Mavinpro Fitness is not liable for:

Incidental or consequential damages

Loss of profits or business disruptions

Personal injuries resulting from improper use

(C) Waiver Requirement

A waiver document must be signed before finalizing the order.

Once the order is delivered, the Buyer assumes full responsibility for the Product.

7. FORCE MAJEURE

Mavinpro Fitness is not liable for delays or inability to perform due to causes beyond its reasonable control, including:

Natural disasters (earthquakes, floods, hurricanes)

Labor strikes or shortages

Government regulations or restrictions

Transportation disruptions

If a force majeure event occurs, delivery timelines will be adjusted accordingly.

8. CONSUMER-SPECIFIC TERMS

(A) Home Use vs. Commercial Use

Some Mavinpro Fitness equipment is designed for commercial use only and may not be covered under warranty if used for residential purposes.

Buyers should confirm intended use before purchasing.

(B) Assembly & Installation

Certain Products require professional assembly. Mavinpro Fitness is not responsible for damages caused by improper self-assembly.

(C) Product Availability & Substitutions

Mavinpro Fitness reserves the right to substitute Products of equal or better quality if a specific model is unavailable.

9. COMPLIANCE WITH LAWS

(A) Export Compliance

The Buyer agrees to comply with all applicable export laws and regulations.

(B) Regulatory Compliance

Buyers are responsible for ensuring that Products comply with local, state, and federal regulations.

10. GOVERNING LAW & DISPUTE RESOLUTION

(A) Governing Law

This Agreement is governed by the laws of the State of California.

(B) Dispute Resolution

Any disputes shall be resolved exclusively in the courts of Los Angeles, California.

11. ENTIRE AGREEMENT

This Agreement represents the entire understanding between Mavinpro Fitness and the Buyer, superseding all prior agreements.

No changes or waivers are valid unless in writing and signed by both parties.
